Terms of Use

1. Acceptance and eligibility

Golf Cart Match is operated by Karnig Ventures. These Terms govern your access to GolfCartMatch.com and related marketplace services (collectively, the “Service”). By browsing, submitting a dealership application, creating a listing, or paying a listing fee, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally able to enter a binding agreement.

2. Marketplace role

Golf Cart Match is an advertising and discovery platform. We are not the buyer, seller, owner, dealer, broker, transporter, lender, insurer, escrow agent, title service, or payment processor for any golf cart transaction. We do not take possession of carts, guarantee a sale, inspect vehicles, verify titles, arrange shipping, or receive the purchase price between buyer and seller.

Stripe processes Golf Cart Match listing fees only. A payment to Golf Cart Match is not a deposit on, payment for, or reservation of a listed cart.

3. Listings and seller responsibilities

A seller must own the cart or be authorized to advertise it. Listing information, photos, price, condition, location, road or LSV status, battery information, modifications, delivery claims, and contact details must be accurate and not misleading. Private sellers must complete the required bot and email-verification steps. Verification confirms control of an email address; it is not an identity, ownership, title, or vehicle inspection. Sellers are responsible for complying with applicable advertising, dealer-licensing, title, registration, tax, recall, safety, and consumer-protection laws.

Do not list stolen property, carts with concealed title or ownership problems, unlawful modifications, fraudulent financing offers, unrelated products, or content that infringes another person’s rights. Dealerships must identify themselves accurately and remain responsible for their inventory feeds.

4. Public content and license

Listings are public. By uploading text, photos, logos, and other content, you represent that you have the necessary rights and grant Golf Cart Match a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, distribute, and promote that content for operating and marketing the Service. This license ends when the content is deleted from active systems, subject to reasonable backup, legal, fraud-prevention, and record-retention needs.

Seller contact email, general location, and listing details may be displayed publicly. Do not upload sensitive documents, payment information, driver’s licenses, titles, or images that reveal information you do not want published.

5. Listing periods, fees, and renewals

Promotional founding listings are free for the stated period and may be limited in number. Standard private listings currently cost $9.95 for 45 days. The price and period shown at checkout control. A paid listing becomes eligible for publication after Stripe confirms payment. An unpaid listing submission and its photos may be removed if checkout is not completed within 24 hours.

Except where required by law or where Golf Cart Match cannot provide the purchased listing service, listing fees are nonrefundable after publication. Listings do not automatically renew. A seller may purchase another 45-day campaign from the private Seller Dashboard without resubmitting the cart details or photos. A renewal purchased while a listing is active extends the then-current expiration date; a renewal purchased after expiration starts a new period when Stripe confirms payment.

At expiration, a listing is disabled from public view and the seller may receive a dashboard or email notice. The listing remains available for renewal for 30 days. If it is not renewed during that window, its listing content, photos, and activity metrics are scheduled for permanent deletion from active systems. A seller may mark a cart sold at any time, which removes it from public view immediately; sold-listing data is also scheduled for deletion after 30 days.

6. Buyer responsibilities and transaction safety

Buyers must independently investigate every cart and seller. Before sending money, inspect the cart, confirm the seller’s identity and authority, review title or registration documents where applicable, check serial numbers, understand local road-use rules, evaluate battery and mechanical condition, and use a secure payment method. Be cautious of urgency, requests for gift cards or cryptocurrency, remote deposits, prices that appear unrealistic, or refusals to permit inspection.

All negotiation, payment for the cart, taxes, financing, insurance, pickup, freight, delivery, registration, and title transfer are solely between buyer, seller, and their chosen providers.

7. Sample listings and marketplace information

Content labeled “Sample listing,” “Demo,” or similar language is fictional demonstration content and is not an offer to sell. Search results, view counts, delivery distances, and seller-provided facts may be incomplete or inaccurate. Golf Cart Match does not endorse a seller or cart merely by displaying it.

8. Moderation and enforcement

Golf Cart Match may review, refuse, limit, suspend, expire, or remove content or access when we reasonably believe it violates these Terms, presents fraud or safety risk, infringes rights, is technically harmful, or could expose users or the Service to liability. Self-service publication does not guarantee continued availability and does not mean that Golf Cart Match has verified a listing.

9. Prohibited use

You may not scrape or harvest seller information, send spam, impersonate another person, interfere with the Service, bypass access controls, upload malware, manipulate listing metrics, use automated systems at an unreasonable rate, reverse engineer protected portions of the Service, or use the Service for unlawful, deceptive, or abusive activity.

10. Intellectual property

The Golf Cart Match name, logos, design, software, and original content are owned by Golf Cart Match or its licensors. These Terms do not transfer ownership. You may use the Service only for its intended marketplace purposes.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLF CART MATCH DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SAFETY, AND RESULTS. WE DO NOT WARRANT ANY CART, SELLER, BUYER, DEALER, LISTING, COMMUNICATION, OR TRANSACTION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLF CART MATCH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS OR DATA; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM A CART OR TRANSACTION; OR LOSSES CAUSED BY USERS, FRAUD, SHIPPING, PAYMENT, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE LISTING FEES YOU PAID TO GOLF CART MATCH DURING THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Golf Cart Match and its operators harmless from claims, losses, liabilities, and reasonable costs arising from your listing, content, transaction, violation of these Terms or law, or infringement of another person’s rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not eligible for small-claims court will be brought in a state or federal court with jurisdiction in Florida, and the parties consent to personal jurisdiction there. Nothing in these Terms limits rights that cannot lawfully be waived.

15. Changes and contact

We may update these Terms as the Service changes. The effective date will be updated, and material changes may receive additional notice when appropriate. Continued use after an update means acceptance of the revised Terms.
